Regional court of Berlin grants interim injunction against selection decision

With respect to today’s ruling in the interim proceedings against the selection decision within the electricity concession tendering process, Stromnetz Berlin GmbH states:

“Stromnetz Berlin welcomes today’s ruling of the Berlin Regional Court with respect to the electricity concession tendering procedure. After the hearing that took place on October 17th, the court has granted our application for an interim injunction against the selection decision and, thus, prohibits the state of Berlin from entering into a new concession agreement with state-owned Berlin Energie. Thereby, the court confirmed our legal opinion that the selection decision was incorrect. 

We sincerely regret the course of the concession award process so far, especially since we submitted a fair and attractive offer of cooperation to the state of Berlin in addition to our concession bid. This cooperation bid has not been recognized and assessed yet. It includes shares of Stromnetz Berlin GmbH and can be accepted by the state of Berlin at any time.

Quite apart from the legal proceedings, Stromnetz Berlin remains ever dedicated to guaranteeing the quality of supply within the Berlin distribution network and continues to press ahead with the digitisation and modernisation of the grid in the interests of all of its customers."
