Concession: Stromnetz Berlin considers selection decision to be unlawful

The Senate Department of Finance informed us on 11 March 2019 that it had made a selection decision in favour of the state-owned bidder Berlin Energie as part of the concession process for electricity and therefore intends to conclude a new concession agreement with Berlin Energie.
We sincerely regret this decision, as we submitted an offer of cooperation on an equal basis to the state of Berlin (in addition to a concession bid), and the Berlin Senate continues to reject our readiness to enter into a partnership.
Following a thorough examination of the reasons given for the decision and the relevant documents provided to us by the awarding body, we have reached the conclusion that the selection decision is unlawful. The Energy Industry Act (Energiewirtschaftsgesetz) stipulates that any recognisable complaints should be notified within 30 days with the possibility of judicial clarification for the unsuccessful bidder if the notified complaints are not remedied.
Quite apart from the Senate Department's decision and the legal proceedings that are now expected, Stromnetz Berlin will continue to dedicate itself to guaranteeing the quality of supply within the Berlin distribution network and press ahead with the digitisation and modernisation of the grid in the interests of all of its customers.
